II.3. EXEMPTION FOR THE ADDS THAT ARE PART OF BOOKS, NEWSPAPERS AND PERIODICALS – THE REFLECTION ON THE INSERTS

Foi conjugando os fatores de ordens jurídico/políticas que fundamentam cada regra de imunidade, que o Supremo Tribunal Federal, acerca dos anúncios publicados em revistas, jornais e periódicos, entendeu serem os mesmos imunes.

It was considering the juridical/political factors that base each exemption rule, that the Supremo Tribunal Federal understood that the adds published in magazines, newspapers and periodicals are really exempt.

Com efeito, ao julgar o RE Nº 111.228 - SP (RTJ 122/1127 até 1130), o Ministro Célio Borja, no que foi acompanhado por unanimidade, rememorando posição histórica do Supremo Tribunal, deixou claro em seu voto:

In fact, when judging RE Nr. 111.228 - SP (RTJ 122/1127 to 1130), the Minister Célio Borja, unanimously accompanied , recalling the historical position of the Supremo Tribunal, made clear when voting:

A Constituição de 1967 e a EC nº 1/69, ao ampliarem a imunidade constante na Constituição de 1946 - e que se adstringia ao papel destinado exclusivamente à impressão de jornais, periódicos e livros - quis, inequivocamente, facilitar e estimular os veículos de divulgação de idéias, conhecimentos e informações que são os livros, os jornais e os periódicos. Como acentua Baleeiro (Limitações Constitucionais ao Poder de Tributar, 5ª ed., p. 198) “a imunidade do art. 19, III, d, da Emenda Nº 1/69 traz endereço certo à proteção dos meios de comunicação de idéias, conhecimentos e informações, enfim de impressão do pensamento como objetivo precípuo”.

The 1967 Constitution and EC nr. 1/69, when increased the exemption mentioned in the 1946 Constitution  - which was restricted to the paper used exclusively to the printing of newspapers, periodicals and books – wanted, undoubtedly, facilitate and stimulate the vehicles divulging ideas, knowledge and information that are the books, the newspapers and the periodicals. As Baleeiro emphasizes (Constitutional Limitations to the Taxation Power, 5th ed., p. 1987) “the exemption of art. 19, III, d, of Amendment nr. 1/69, addresses the protection of the means that communicate ideas, knowledge and information, in short, the thought printing as its main objective”.

E essa proteção se dá, no campo tributário com a imunidade fiscal que se destina, diretamente, a reduzir o custo de produção e comercialização dos livros, jornais e periódicos.

And this protection takes place, in the tax area, with the tax exemption that aims at, directly, the cost reduction of the production and commercialization of books, newspapers and periodicals.

Veja que o Supremo Tribunal Federal nessa decisão não consignou a imunidade tão somente para o produto final. O fez levando em consideração que a imunidade deve ter em vista a redução do custo de produção e comercialização.

Note that the Supremo Tribunal Federal, in this decision, did not designated the exemption only to the end product. It was taking into consideration that the exemption may consider the cost reduction of the production and commercialization.

Redução do custo de produção dos livros, jornais e periódicos, só se consegue com a imunidade integrada do produto final com todos os produtos (meios) que de alguma forma integram (ainda que financeiramente) o produto final, tendo em vista a inexorabilidade do repasse de custos no sistema produtivo.

The cost reduction in the production of books, newspapers and periodicals can only be obtained with the exemption integrating the end product to all the products (means) that integrate in some way (even if financially) the end product, considering the inexorability of passing the costs of the productive system.
